1. เกี่ยวกับ TuaTop

TuaTop เป็นแพลตฟอร์ม creator marketplace ที่เชื่อมต่อร้านค้าและแบรนด์กับครีเอเตอร์เพื่อสร้างงาน โปรโมตสินค้า จัดการแคมเปญ แชทงาน ถือเงินแบบ escrow จ่ายเงินให้ครีเอเตอร์ จัดการ affiliate และเชื่อมต่อข้อมูล Commerce OS เช่น Lazada เมื่อผู้ใช้เปิดใช้งานฟีเจอร์นั้น

ผู้ให้บริการคือ บริษัท คลาวด์ คอนเนคท์ เอเซีย จำกัด (Cloud Connect Asia Co., Ltd.) เลขประจำตัวผู้เสียภาษี 0105566079201 สำนักงานตามที่อยู่ 3/1-3/3 ถนนพระรามที่ 3 แขวงบางคอแหลม เขตบางคอแหลม กรุงเทพมหานคร 10120

2. บัญชีและบทบาทผู้ใช้

• Merchant สร้างงาน เติมเงิน Wallet จ้างครีเอเตอร์ อนุมัติงาน ทำแคมเปญ affiliate และใช้ Commerce OS
• Creator สมัครงาน รับงาน ส่งงาน รับเงิน สร้างโปรไฟล์ เชื่อมช่องทางที่รองรับ และรับงาน affiliate
• Admin ตรวจ KYB/KYC, Bookbank, ธุรกรรม, ข้อพิพาท, ความปลอดภัย และช่วยเหลือผ่าน Support Chat

ผู้ใช้ต้องให้ข้อมูลจริง ไม่สวมรอย ไม่เปิดหลายบัญชีเพื่อหลบเลี่ยงกฎ และต้องรักษารหัสผ่านหรือช่องทางเข้าสู่ระบบของตนเองให้ปลอดภัย

3. Wallet, Escrow และค่าธรรมเนียม

• การเติมเงิน Wallet ของ merchant เป็นเงินมัดจำหรือ prepaid balance เพื่อใช้จ่ายภายในแพลตฟอร์ม ยังไม่คิด VAT ตอนเติมเงิน
• ช่องทางเติมเงินที่ใช้งานปัจจุบันคือโอนเงินเข้าบัญชี/แนบสลิปเพื่อตรวจสอบ ช่องทาง QR, PromptPay, บัตรเครดิต หรือ K+ จะแสดงเฉพาะเมื่อระบบพร้อมและเปิดใช้งานแล้ว
• ค่าธรรมเนียมแพลตฟอร์มของ merchant รวม VAT 7% แล้ว โดยแผน Free คิด 8% และแผน Pro คิด 5% ของมูลค่างานหรือรายการที่เข้าเกณฑ์
• ค่า platform fee ขั้นต่ำอาจใช้ที่ ฿20 ต่อรายการเมื่อระบบแสดงไว้ในหน้าทำรายการ
• แผน Pro มีราคา ฿990 ต่อ 30 วัน และสิทธิประโยชน์ขึ้นกับหน้าจอที่ระบบแสดง ณ วันที่สมัคร
• Featured Boost สำหรับงานมีราคาโดยประมาณ 3 วัน: Free ฿249 / Pro ฿149, 7 วัน: Free ฿499 / Pro ฿299, 14 วัน: Free ฿829 / Pro ฿499 เว้นแต่ระบบแสดงราคาใหม่ก่อนยืนยัน
• เมื่อ merchant จ้าง creator ระบบจะล็อกเงินไว้ใน escrow จนงานสำเร็จ ยกเลิก หรือเข้าสู่การพิจารณาข้อพิพาท
• creator ที่ถอนเงินต้องผ่าน KYC และส่ง Bookbank หรือหน้าบัญชีธนาคารเพื่อให้ระบบ/แอดมินตรวจชื่อบัญชี เลขบัญชี และธนาคาร ยอดถอนขั้นต่ำปัจจุบันคือ ฿100 การถอนครั้งแรกจำกัด ฿3,000 และมีคำขอรออยู่ได้ครั้งละ 1 รายการ
• รายได้ creator อาจถูกหักภาษี ณ ที่จ่าย 3% เมื่อเข้าเงื่อนไขตามกฎหมายไทยและเอกสาร 50 ทวิที่ระบบออกให้

4. Refund และการถอนยอดคงเหลือ

• merchant ขอคืนเงิน Wallet ได้เฉพาะยอด top-up ที่ยังไม่ได้ใช้ ยังไม่ถูกล็อกใน escrow และไม่มีข้อพิพาทหรือ hold ที่เกี่ยวข้อง
• ต้องแนบ Bookbank หรือหน้าบัญชีธนาคาร และ TuaTop จะโอนคืนเข้าบัญชีเดียวกับบัญชีที่โอนเติม Wallet เข้ามาเท่านั้น
• หลังตรวจสอบข้อมูลและบัญชีต้นทางตรงกันแล้ว ระบบจะดำเนินการโอนคืนภายใน 48 ชั่วโมง
• การคืนยอด top-up ที่ยังไม่ได้ใช้ไม่ถือเป็นค่าบริการ จึงไม่มี VAT และไม่ต้องออก credit note
• หากต้องคืน platform fee ที่เคยออกใบกำกับภาษีแล้ว จะต้องใช้ flow credit note แยกต่างหากเมื่อระบบรองรับ

5. Dormant Wallet และ Wallet Terms

หาก merchant wallet ไม่มี qualifying activity ต่อเนื่องครบ 12 เดือน บัญชีอาจเข้าเกณฑ์ inactive wallet และอาจมี wallet maintenance fee เดือนละ ฿100 เฉพาะจากยอด Wallet พร้อมใช้เท่านั้น ระบบจะไม่ทำให้ยอดติดลบ และจะหยุดอัตโนมัติเมื่อยอดพร้อมใช้เป็น ฿0 หรือเมื่อมีการ reactivate account

ระบบจะไม่คิด wallet maintenance fee จนกว่า merchant จะยอมรับ Wallet Terms เวอร์ชันล่าสุดที่ระบุนโยบายนี้อย่างชัดเจน และต้องมีการแจ้งเตือนล่วงหน้าตาม schedule ที่กำหนด เช่น 9 เดือน, 11 เดือน, 30 วันก่อนเริ่ม fee และ 7 วันก่อนเริ่ม fee

กิจกรรมที่นับเป็น qualifying activity รวมถึง login, deposit, withdrawal, สร้างงานหรือแคมเปญ, อนุมัติงาน creator, ชำระค่างาน, ส่งข้อความที่เกี่ยวข้องกับงาน, ยอมรับ terms ใหม่, อัปเดต merchant profile, ติดต่อ support จากบัญชีที่ล็อกอิน และธุรกรรม Wallet ที่ผู้ใช้เริ่มเอง โดยไม่รวม notification อัตโนมัติหรือ system-generated maintenance fee

6. การเชื่อมต่อแพลตฟอร์มภายนอก

• TikTok OAuth เป็นช่องทางที่เปิดใช้งานสำหรับการเชื่อมบัญชีและ sync ข้อมูลตามสิทธิ์ที่ผู้ใช้อนุญาต
• Facebook, Instagram และ YouTube OAuth ถูกปิดไว้ก่อนจนกว่า API key, permission และ approval ที่จำเป็นจะพร้อมใช้งาน
• Lazada เชื่อมผ่าน Commerce OS / Lazada Open Platform OAuth ได้แล้ว ส่วน Shopee และ TikTok Shop ยังรอ partner approval
• TuaTop จะไม่โพสต์แทนผู้ใช้ ไม่ส่งข้อความหาผู้ติดตาม และไม่ขาย raw token ให้บุคคลที่สาม

7. Content Safety, AI และการใช้งานที่ยอมรับได้

ระบบอาจใช้ AI และ rule-based moderation เพื่อตรวจจับคำหยาบ การด่าทอ เนื้อหาลามก คุกคาม hate speech scam spam หรือข้อความที่พยายามพาผู้ใช้ไปทำธุรกรรมนอกแพลตฟอร์ม ถ้าพบความเสี่ยง ระบบอาจห้ามส่ง ห้ามโพสต์ แจ้งว่าผิดตรงไหน ส่งให้แอดมินตรวจ หรือระงับบัญชีชั่วคราว

หากบัญชี spam chat เกิน 5 ครั้งในช่วงที่ระบบกำหนด TuaTop อาจระงับบัญชี 3 วัน และบันทึก audit log ไว้เพื่อความปลอดภัยของแพลตฟอร์ม

8. งาน, การอนุมัติ และข้อพิพาท

merchant และ creator ต้องใช้ chat และ job workflow ในระบบเพื่อเก็บหลักฐาน งานที่ส่งแล้วควรได้รับการ review ภายในเวลาที่ระบบกำหนด หากไม่มีการตอบกลับอาจเข้าสู่ auto-approval ตาม policy ของงานนั้น ข้อพิพาทจะถูกส่งให้ admin ตรวจหลักฐานและตัดสินตามข้อมูลในระบบ

9. ภาษีและเอกสาร

platform fee ที่ merchant เห็นเป็นยอดรวม VAT แล้ว TuaTop อาจออก e-tax receipt เมื่อเข้าเงื่อนไข รายได้ creator อาจมีหนังสือรับรองการหักภาษี ณ ที่จ่ายตามกฎหมาย ผู้ใช้มีหน้าที่ตรวจสอบข้อมูลภาษีของตนเองและปรึกษาที่ปรึกษาภาษีเมื่อจำเป็น

10. การเปลี่ยนแปลงและการติดต่อ

TuaTop อาจปรับปรุงข้อกำหนดนี้ โดยวันที่ปรับปรุงล่าสุดจะเปลี่ยนตามจริง การเปลี่ยนแปลงสำคัญจะแจ้งผ่าน in-app, email หรือ LINE OA ตามช่องทางที่มี ข้อสงสัยติดต่อ admin@tuatop.com

อัปเดตระบบล่าสุด: Business Plus, Event Suite และ Event Quest

TuaTop มีแพ็กเกจและฟีเจอร์เพิ่มเติมสำหรับร้านค้า ได้แก่ TuaTop Business Plus, Event Suite, Event Scale 5K และ Event Quest / Booth Mission. การใช้งานฟีเจอร์เหล่านี้อยู่ภายใต้ข้อกำหนดนี้และเงื่อนไขที่แสดงในหน้าจอก่อนซื้อหรือก่อนเปิดใช้งาน.

• Business Plus รวม Event Suite สำหรับสร้าง Event, KOL Page, registration, approval, QR Pass, staff scanner, mission และ export report. ไม่ใช่แพ็กเกจ unlimited.
• Event Scale 5K เป็น add-on ราย event สำหรับงานใหญ่ โดย limit, staff, gate, export, support และราคาต้องอ้างอิงหน้าจอที่แสดงก่อนชำระเงิน.
• Event Quest ใช้ QR 3 ประเภท: Event Pass QR สำหรับเข้างาน, Booth Start QR สำหรับเริ่มภารกิจบูธ และ Gift Pass QR สำหรับรับของ. Gift Pass QR ใช้ได้ตามกติกาและอาจถูกปฏิเสธถ้าซ้ำ, หมดอายุ, ผิดบูธ, staff ไม่มีสิทธิ์, stock หมด หรือเกิน Daily Booth Limit.
• Creator ต้องยอมรับ Creator Job Terms / Event Terms / PDPA และ Payment & Withdrawal Terms ตาม action ที่เกี่ยวข้อง เช่น สมัครงาน, สมัคร Event, ส่งงาน หรือถอนเงิน.
• Merchant มีหน้าที่กรอกข้อมูล Event, deadline, reward, mission, terms, venue, staff และ stock ให้ถูกต้อง. TuaTop ไม่รับผิดชอบความเสียหายจากข้อมูลที่ผู้จัดงานกรอกผิด ยกเว้นตามที่กฎหมายกำหนด.
• Wallet purchase สำหรับ Pro, Business Plus หรือ add-on ใด ๆ จะมีผลตามแพ็กเกจที่ระบบแสดงและบันทึก audit ณ เวลาชำระเงิน.

ข้อมูลการติดตามผลและโฆษณา

เว็บไซต์อาจใช้ Google tag, Google Ads conversion, Meta Pixel, affiliate click tracking และ analytics event เพื่อวัด PageView, signup, top-up, campaign publish, package purchase, event registration และ conversion ที่เกี่ยวข้อง. ระบบไม่ควรส่งข้อมูลส่วนบุคคลที่ละเอียดอ่อนหรือเอกสาร KYC ไปยัง advertising platform ในเวอร์ชันปัจจุบัน.

1. About TuaTop

TuaTop is a creator marketplace connecting merchants and brands with creators for jobs, campaigns, escrow, creator payouts, affiliate work, support chat, and Commerce OS integrations such as Lazada when enabled by the user.

The service is operated by บริษัท คลาวด์ คอนเนคท์ เอเซีย จำกัด (Cloud Connect Asia Co., Ltd.), Tax ID 0105566079201, located at 3/1-3/3 Rama III Road, Bang Kho Laem, Bang Kho Laem, Bangkok 10120, Thailand.

2. Accounts and Roles

• Merchants create jobs, top up Wallet, hire creators, approve work, run affiliate campaigns, and use Commerce OS.
• Creators apply for jobs, accept work, submit deliverables, receive payouts, manage a profile, connect supported channels, and join affiliate campaigns.
• Admins review KYB/KYC, Bookbank, transactions, disputes, safety issues, and support requests.

Users must provide truthful information, must not impersonate others, and must not create multiple accounts to avoid rules, fees, review, or enforcement.

3. Wallet, Escrow, and Fees

• Merchant Wallet top-up is treated as customer deposit or prepaid balance for use inside TuaTop. VAT is not charged at top-up.
• The currently active top-up flow is bank transfer with slip verification. QR, PromptPay, card, or K+ payment options are shown only when the system is ready and the option is enabled.
• Merchant platform fees are VAT-inclusive. Free plan fee is 8%; Pro plan fee is 5% for eligible jobs or transactions.
• A minimum platform fee such as THB 20 may apply where displayed before confirmation.
• Pro plan currently costs THB 990 per 30 days. Benefits are shown in the product screen at the time of subscription.
• Featured Boost pricing is currently 3 days: Free THB 249 / Pro THB 149, 7 days: Free THB 499 / Pro THB 299, 14 days: Free THB 829 / Pro THB 499, unless a newer price is displayed before confirmation.
• When a merchant hires a creator, funds are locked in escrow until the job is completed, cancelled, or reviewed through dispute handling.
• Creator withdrawals require KYC and a Bookbank or bank account page so the system/admin can verify bank name, account name, and account number. The current minimum withdrawal is THB 100. First withdrawal is limited to THB 3,000 and only one pending request is allowed at a time.
• Creator income may be subject to 3% withholding tax when required by Thai law and the 50 bis certificate flow.

4. Refunds and Remaining Balance Withdrawal

• Merchants may request a refund only for unused Wallet top-up balance that is not locked in escrow and not affected by dispute or hold.
• A Bookbank or bank account page is required. TuaTop will transfer the refund only to the same bank account that was used to top up the Wallet.
• After verifying the source account and submitted bank details, TuaTop will process the refund transfer within 48 hours.
• Refund of unused top-up is not a service fee refund, so no VAT or credit note is created for that refund.
• If a platform fee with an issued tax invoice must be refunded, a separate credit note flow is required when supported.

5. Dormant Wallet and Wallet Terms

If a merchant wallet has no qualifying activity for 12 consecutive months, the account may become an inactive wallet and may become eligible for a wallet maintenance fee of THB 100 per month. The fee is deducted only from available Wallet balance, never makes the balance negative, and stops automatically when the available balance reaches THB 0 or the account is reactivated.

No wallet maintenance fee will be charged unless the merchant has accepted the latest Wallet Terms version that clearly includes this policy and all required advance notices were sent, including the 9-month, 11-month, 30-day, and 7-day notices where applicable.

Qualifying activity includes login, deposit, withdrawal, creating a job or campaign, approving creator work, paying for a job, sending job-related messages, accepting updated terms, updating merchant profile, contacting support from a logged-in account, and user-initiated Wallet transactions other than system maintenance fee. Automated notifications and scheduled jobs do not count.

6. External Platform Connections

• TikTok OAuth is enabled for account connection and data sync based on the permissions granted by the user.
• Facebook, Instagram, and YouTube OAuth are currently disabled until required API keys, permissions, and approvals are ready.
• Lazada is available through Commerce OS / Lazada Open Platform OAuth. Shopee and TikTok Shop are pending partner approval.
• TuaTop does not post on your behalf, message your followers, or sell raw tokens to third parties.

7. Content Safety, AI, and Acceptable Use

TuaTop may use AI and rule-based moderation to detect profanity, insults, sexual content, harassment, hate speech, scam, spam, or attempts to move transactions off-platform. If risk is detected, the system may block sending or posting, explain what needs to be fixed, escalate to admin review, or temporarily suspend the account.

If an account sends spam chat more than 5 times within the configured enforcement window, TuaTop may suspend the account for 3 days and keep an audit log for platform safety.

8. Jobs, Approval, and Disputes

Merchants and creators should use the in-app chat and job workflow so evidence is retained. Submitted work should be reviewed within the period shown in the job. If there is no response, auto-approval may apply based on the job policy. Disputes are reviewed by admins based on evidence available in the system.

9. Tax and Documents

Merchant platform fees are shown VAT-inclusive. TuaTop may issue e-tax receipts when eligible. Creator income may be covered by withholding tax certificates under Thai law. Users are responsible for their own tax position and should consult an advisor when needed.

10. Changes and Contact

TuaTop may update these Terms, and the Last updated date will reflect changes. Material changes may be announced by in-app notification, email, or LINE OA. Questions may be sent to admin@tuatop.com.

Current Platform Update: Business Plus, Event Suite, and Event Quest

TuaTop now includes additional merchant products: TuaTop Business Plus, Event Suite, Event Scale 5K, and Event Quest / Booth Mission. These features are governed by these Terms and the package, limit, and price shown before purchase or activation.

• Business Plus includes Event Suite for event creation, KOL page, registration, approval, QR pass, staff scanner, missions, and export reports. It is not an unlimited package.
• Event Scale 5K is a per-event add-on for large events. Limits, staff, gates, exports, support, and price are those shown before payment.
• Event Quest uses three QR types: Event Pass QR for entry, Booth Start QR to start a booth mission, and Gift Pass QR for redemption. A Gift Pass QR may be rejected if it is duplicate, expired, for the wrong booth, scanned by unauthorized staff, out of stock, or over the Daily Booth Limit.
• Creators must accept the relevant Creator Job Terms, Event Terms / PDPA, and Payment & Withdrawal Terms before actions such as applying, registering for events, submitting work, or withdrawing money.
• Merchants are responsible for accurate event details, deadlines, rewards, missions, terms, venue, staff, and stock. TuaTop is not responsible for loss caused by incorrect event information supplied by an organizer, except as required by law.
• Wallet purchase for Pro, Business Plus, or add-ons is governed by the package displayed and audit log recorded at payment time.

Tracking and Advertising Measurement

The website may use Google tag, Google Ads conversions, Meta Pixel, affiliate click tracking, and analytics events to measure PageView, signup, top-up, campaign publish, package purchase, event registration, and related conversions. Sensitive identity documents and KYC data should not be sent to advertising platforms in the current version.
